• “Entitlement” means your right to access/download/use a product based on a purchase or grant.

Subject to your compliance with this EULA, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Software for your own lawful use.

Some products may include product-specific license terms shown at purchase or within the product. If product-specific terms conflict with this EULA, the product-specific terms control for that product.

• You may use the Software only as permitted by this EULA and any product-specific terms.
• You may not use the Software for unlawful purposes.
• You are responsible for your environment, device, internet connection (if required), and compatible system requirements.

You agree not to do any of the following (unless explicitly allowed by law):

• No resale/distribution: sell, rent, lease, sublicense, distribute, or transfer the Software or access to it.
• No license bypass: bypass or attempt to bypass licensing checks, entitlement checks, download gating, or access controls.
• No reverse engineering: reverse engineer, decompile, disassemble, or attempt to extract source code, except where permitted by law.
• No tampering: modify the Software to remove branding, notices, security features, or technical protections.
• No malicious use: use the Software to create or distribute malware, or to compromise systems or accounts.

The Software is licensed, not sold. Moonskai Labs (and/or our licensors) retains all rights, title, and interest in the Software, including all intellectual property rights. You receive only the limited license granted in this EULA.

• Updates: We may provide updates, patches, or new versions at any time.
• Required updates: Some updates may be required for continued use (for example, security fixes or compatibility changes).
• Changes: Features may be added, removed, or modified over time.

We are not obligated to provide any particular update schedule or to maintain features indefinitely, except where required by law or an explicit written agreement.

Support availability may vary by product and may change over time. If support is offered, it may be subject to reasonable limits. For help, please contact us.

Some products or site functionality may rely on third-party services (for example, payment processing through Paddle). Your use of third-party services may be subject to their terms and policies, and Moonskai Labs is not responsible for third-party services outside our control.

This license is effective until terminated. We may terminate or suspend the license if you violate this EULA or if we reasonably suspect fraud or abuse. Upon termination, you must stop using the Software and delete/destroy any copies under your control where applicable.

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Some jurisdictions do not allow certain warranty disclaimers, so some of the above may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOONSKAI LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SOFTWARE GIVING RISE TO THE CLAIM DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

You agree to comply with applicable export control and sanctions laws. You may not use or export the Software in violation of applicable laws.

This EULA is governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles.

We may update this EULA from time to time. The “Last updated” date reflects the most recent revision. If changes are material, we may provide additional notice where required by law.
