You may use the Services only if you can legally enter into a binding agreement and your use is permitted by applicable law. If you use the Services on behalf of a business or other organization, you represent that you have authority to bind that organization.

If you do not agree to these Terms, do not use the Services or purchase our products.

• You are responsible for providing accurate account information and keeping it reasonably current.
• You are responsible for maintaining the confidentiality of your login credentials and for activity under your account.
• You must not impersonate another person, misrepresent your identity, or use another person’s account without permission.
• Please contact us promptly if you believe your account has been accessed without authorization.

Moonskai Labs may offer free software, paid software, downloadable products, browser-based applications, cloud-hosted applications, plug-ins, updates, and other digital products.

Unless a product page, license, or End User License Agreement states otherwise, purchasing or accessing a product gives you a limited, non-exclusive, non-transferable right to use that product for its intended purpose. You do not acquire ownership of the underlying software, source code, trademarks, or other intellectual property.

Where a separate End User License Agreement applies to a software product, that agreement governs software-license terms. If there is a direct conflict between these Terms and the applicable EULA on a software-license issue, the EULA controls for that issue.

Paid products are sold through Dodo Payments, which acts as the Merchant of Record for applicable transactions. Dodo Payments handles payment processing and may collect billing, tax, fraud-prevention, and transaction information needed to complete a purchase.

Your purchase may also be subject to Dodo Payments' applicable buyer terms and policies. Moonskai Labs does not store your full payment card details.

Prices are displayed on the applicable product or checkout page and may change for future purchases. Taxes may be calculated and collected as required by law and by the payment provider.

We may change, discontinue, replace, or limit products or features at any time, but this does not remove rights you have under applicable law or an existing purchase agreement.

Digital products may be delivered through downloads, account entitlements, browser access, cloud-hosted access, license records, or other electronic delivery methods described on the product page.

You are responsible for using compatible hardware, software, browsers, operating systems, internet access, and other requirements reasonably needed to use the product.

Refund requests are handled according to our Refund Policy, Dodo Payments' applicable buyer terms, and any rights provided by applicable law. Because our products are digital, eligibility may depend on the product, delivery status, access, use, and other circumstances described in those policies.

Approved refunds for Dodo Payments-processed purchases are processed through Dodo Payments, generally to the original payment method where possible.

When a purchase is fully refunded, access to the associated digital product may be revoked.

You agree not to misuse the Services. Prohibited conduct includes:

• Using the Services for unlawful, fraudulent, abusive, or harmful activity.
• Attempting to gain unauthorized access to accounts, systems, servers, data, or restricted areas.
• Interfering with the security, integrity, availability, or normal operation of the Services.
• Uploading or transmitting malicious code, malware, or content intended to damage or compromise systems.
• Using automated methods to overload, scrape, probe, or abuse the Services in a manner that disrupts normal operation.
• Removing or altering copyright, trademark, license, or ownership notices where prohibited by the applicable license.

The Services, including software, designs, interfaces, text, graphics, logos, product names, documentation, and other original materials, are owned by Moonskai Labs L.L.C. or its licensors and are protected by applicable intellectual-property laws.

Except for rights expressly granted by these Terms, a product license, or an applicable EULA, no rights are transferred to you.

If a Service allows you to upload or create content, you retain ownership of your content. You grant us only the rights reasonably necessary to host, process, display, transmit, or otherwise handle that content to operate and support the Service you requested.

If you voluntarily provide suggestions or feedback, you agree that we may use that feedback without restriction or compensation, provided we do not claim ownership of your unrelated personal content.

The Services may rely on or link to third-party services such as payment processors, hosting providers, email providers, or external websites. Those third parties operate under their own terms and privacy practices.

We are not responsible for third-party services that we do not control, except to the extent required by applicable law.

Our collection and handling of personal information is described in our Privacy Policy. Our use of cookies and similar technologies is described in our Cookie Policy.

We work to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, updates, internet outages, security events, third-party failures, or other circumstances may temporarily affect availability.

We may update the Services, fix bugs, change features, or modify technical requirements when reasonably necessary.

We may suspend or terminate access when reasonably necessary to address fraud, abuse, security risks, violations of these Terms, legal requirements, or threats to the Services or other users.

Provisions that by their nature should survive termination — including intellectual-property, payment, warranty, liability, and dispute-related provisions — remain in effect as applicable.

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis. We disclaim warranties that are not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent those disclaimers are permitted by law.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

To the maximum extent permitted by applicable law, Moonskai Labs L.L.C. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from or related to the Services.

To the maximum extent permitted by applicable law, our aggregate liability arising from or related to a paid product will not exceed the amount you paid to Moonskai Labs for that specific product during the twelve months preceding the event giving rise to the claim.

These limitations do not apply where prohibited by law.

To the extent permitted by law, you agree to indemnify and hold harmless Moonskai Labs L.L.C. from claims, losses, liabilities, and reasonable costs arising from your unlawful misuse of the Services, your violation of these Terms, or your infringement of another person’s rights.

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Nothing in these Terms limits any non-waivable rights you may have under the laws that apply to you.

We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes may also be communicated through the website or other reasonable means when appropriate.

Your continued use of the Services after revised Terms become effective means you accept the revised Terms, to the extent permitted by law.

• Entire agreement: These Terms, together with applicable product terms, policies, and EULAs, form the agreement governing your use of the Services.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.
• No waiver: A failure to enforce a provision does not waive our right to enforce it later.
• Assignment: You may not transfer your rights or obligations under these Terms where prohibited by an applicable license or without our consent.
